Bias in the Courtroom:
How Identity Impacts Credibility, Negotiation, and Litigation
Bias, whether conscious or unconscious, can influence how professionals assess credibility, evaluate claims, negotiate disputes, and navigate litigation. Attorneys and insurance professionals routinely interact with individuals from diverse cultural, religious, and personal backgrounds, making awareness of these influences essential to maintaining objectivity, professionalism, and ethical decision-making.
Through practical examples and professional perspectives, this panel will examine how identity, including the experience of Jewish professionals, can shape interactions with opposing counsel, claims representatives, litigants, and other stakeholders. Panelists will explore strategies for recognizing and addressing assumptions and stereotypes, navigating negotiations involving diverse parties, and understanding how perceptions of identity and credibility may influence jury evaluations and litigation outcomes.
The discussion will also address the professional and ethical responsibilities of attorneys and claims professionals when confronting prejudice, emphasizing fair claims evaluation, evidence-based decision-making, effective communication, and the importance of maintaining impartiality throughout the claims and litigation process.
Attendees will gain practical strategies for identifying potential bias, managing challenging professional interactions, and promoting fairness and professionalism in claims handling, negotiation, and dispute resolution.
